Mediation and Arbitration

Many disputes can be resolved faster, cheaper, and with less collateral damage outside of court. Mediation and arbitration are designed to do exactly that. Both can produce a result in weeks or months rather than years, with predictable cost, scheduling flexibility, and confidentiality that courtroom litigation cannot offer.

I serve in two roles. As a neutral mediator and arbitrator, I help parties resolve their disputes directly. As an attorney, I represent parties in mediation and arbitration proceedings.

Neutral Mediator and Arbitrator Services

I serve as a neutral mediator and arbitrator on a nationwide basis. Acting as a neutral is not the practice of law, which is why these services are available outside the jurisdictions where I am admitted to practice.

As a mediator, my role is to guide the parties to a resolution they negotiate themselves. Mediation usually concludes in one or two sessions, in person or by videoconference, with a written settlement agreement at the end. Even where a session does not produce a final agreement, parties almost always leave with a clearer sense of their own priorities and the realistic range of outcomes.

As an arbitrator, my role is closer to a judge's. I hear the case fairly and neutrally and issue a decision. The parties agree in advance whether the decision is binding or non binding, and whether it can be reviewed by a court.

I completed mediation training through the American Arbitration Association.

Representation in Mediation and Arbitration

When you are a party rather than the neutral, you need an advocate. I represent parties in mediation and arbitration proceedings in New York and Massachusetts, including matters where mediation or arbitration is contractually required and matters where the parties have voluntarily agreed to bypass court.

My representation work covers preparing for the proceeding, presenting evidence and argument, negotiating settlement terms, and where applicable, confirming or challenging arbitration awards in court.
